Petition for Visitation Rights

If you would like to gain visitation rights in order to see your children, the state of Alabama requires for you to fill out the Petition for Visitation form. If you have never filed an order for these children, AL state law requires you to file this form in the same county where your children reside. This form must be completed and submitted to the District Court of the applicable county in Alabama.

How to Complete a Petition for Visitation Form

In order to complete a Petition for Visitation form in Alabama, you are required to provide the following information:

  • Provide your information and the plaintiff’s information:

    • Full name
    • Address
    • Date of birth
    • Phone number
  • Provide the children’s information:

    • Full name
    • Address
    • Date of birth
  • Any other cases made for the stated children
  • Best location to pick up and drop off the children
  • Describe the visitation schedule you are requesting
  • Sign and date the form

Once you have completed the required form, take the original along with two copies of the form to the applicable District Court. You will be required to pay a fee for filing each form with cash or a money order. If you are unable to pay the fee, you will be required to fill out an Affidavit of Substantial Hardship form and sign it in the presence of a notary.
